Australian Student Visa Policy Updates During COVID-19

Due to the impact of COVID-19, the Australian Government has implemented flexible visa conditions for students, recognizing that pandemic restrictions may prevent meeting normal study requirements. Below are some scenarios for parents and students to consider:

1. Visa Expiry Regulations:

Australian immigration law does not allow student visa extensions. If a student visa expires and the student cannot leave Australia, they must apply for a new visa. The following cases apply:

• Continuing Studies: If the student plans to continue their course or needs more time to complete it, they must apply for a new student visa (subclass 500).
• Course Completion & No Further Study: If the course is ending and the student does not intend to pursue further education but cannot leave Australia, they can apply for a tourist visa (subclass 600) to remain legally.

2. Conditions for Maintaining a Student Visa:

• Mode of Study: The Australian Department of Home Affairs (DHA) does not mandate study methods. Students can choose in-person or online learning based on the institution’s guidelines.
• Visa Status: Student visa status remains valid until another visa is applied for or the visa expires. This status is unchanged even if the student returns home or defers their course. There is no need to notify DHA about returning home or deferring studies.

3. Work Rights for Students:

• Full-Time Work: Students may work full-time during course breaks or if they are pursuing a Master's by research or a PhD.
• Course Deferral: If the course is deferred, students can work more than 40 hours per fortnight.

4. Important Notes:

Students should maintain regular communication with their institution and immediately report any changes in their studies to ensure compliance with visa conditions.
